In 2006 my children (twin daughters) moved in with their father (he made promises of cell phones and body piercing and I was to “uptight” to permit such things) – I was sending him a check every week to support both children in addition to providing medical insurance and paying 100% of any medical care that was not covered by insurance. He thought he would get more money if he took me to court – so we went to court and I was ordered to pay the same amount I was paying and there was no wage withholding entered because I had been paying him all along.
In December of the same year both children moved back in with me (I guess the grass isn’t always greener on the other side). I then stopped sending him a weekly check because the girls were now living with me. Since then he has made no effort to help me with the girls in any way shape or form. I have two jobs, I have borrowed money from family and friends and have struggled to take care of them.
I finally saved enough money to take him to court and have him pay child support (I had to take time off from work, pay a $70.00 filing fee – then take more time off from work and pay a sheriff $40.00 to serve him) we went to court on the 16th of October and he was ordered to pay $182.00 a week and 39% of all unpaid medical bills (I pay for the medical insurance and he does not now or has he ever provided medical insurance for them) to date, it has been 10 weeks since our court date, I have received Zero dollars from him.
He is however asking that I pay him $14,000.00 dollars for the past two years and two months because the court order was not modified until 10/16/08. Is there anything I can do to prevent this from happening?
Now, not only is he not paying child support but he is asking that I give him for money for a time period when these children were living with me and he was doing nothing to support them. He will do anything to get out of supporting these children (when they were infants he went as far as to try and sign away his parental rights so he wouldn’t have to send money – this of course was denied) and I have to work two jobs to make sure they are okay.
Please point me in the right direction – I can’t afford an attorney so any information you can give me will be greatly appreciated
