I found out through the Circuit Court Clerk in my County that I can actually go down to the court house and swear a warrant out for the arrest of my ex for non payment of support. They do charge a fee, but may be worth it if I don't get any results from DHR. Has anyone ever done this?
I have never heard of that here in Florida. My ex owes over $40,000 and doesn't have a warrant. The Child Support Office had no valid address to serve him (even though I gave them an address.) This went on for over a year until I wrote my governor and recently got a court date for this September. Then depending if he shows they will finally issue a warrant. If you are able to do that yourself it sounds like it would be much quicker.
I called and found out that if I do swear out a warrant, The Dept. of human resources will stop any enforcement. I am going to try and be patient a while longer now that my case has FINALLY been turned over to the DA's office. If I don't get any results within a few weeks, I may go swear out the warrant. I have been waiting only 6 months this time. Last time I filed a case (in 2005) it took over a year just to get the caseworker to send him a letter stating they would suspend his license. My caseworker told me last week that she is handling 1,000 cases by herself. They are understaffed. There are over 10,000 active cases in my county alone. They are supposed to serve him or attempt to serve him at anytime, but if he isn't home, they can't serve him. So frustrating. I am thinking of hiring a process server to do it for me if they can't serve him at home. A process server will go anywhere to serve him, for a fee. I think it is $100.00 or so, depending on how many times they have to attempt to serve him. It is so silly, they can go to someone's house and arrest them for a bad check....I swore out a warrant on someone for writing me a bad check...but they can't do that with child support offenders!!
I went to the circuit court where my case was files and request his DL be suspeneded. My lawyer was handling my cs case at the time. Now the department of revenue is and it should happen automatically the next time he is not compliant. My case is a little differnet in that my ex is involved in my child's life and I know where he works and when he works. The court system still takes forever even though I know where he is. Keep on it girls. I really think we can make a difference.
Thanks. My ex lives two minutes away. It is so ironic to me that it is so difficult to get results. I am calling the DA today and hopefully someone can tell me something about where we stand as far as serving the papers. I made a friend who has some connections and has told me they will make sure it gets served.
It is ridiculous that it takes so much to get them served. That just sends deadbeats the message that it is okay to break the law. I hope the papers are served soon.
Contact the court where your child support was ordered. Ask them about swearing out
a warrant for your ex's arrest. In the county I live you can do this.
I ran across the Ask Now website, where you can ask a law librarian a question. The site is run by the State of California's library system. Maybe they can give you information on how to swear out an arrest warrant in California.
